Welcome to PreserveWell. These Terms and Conditions ("Terms") govern your use of the PreserveWell website, app, and services (together, the "Service"), operated by McRae Expert Services, LLC ("PreserveWell," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use the Service
You may browse and use the Service if you can form a binding agreement with us. Some features, including any account or paid membership, require you to be at least 18 years old. If you use the Service on behalf of a business, you confirm you are authorized to accept these Terms for it.
2. Your account
Some features require an account. If you create one, you are responsible for keeping your login details secure and for all activity under your account. Tell us right away at info@preservewell.com if you believe your account has been used without your permission.
3. Acceptable use
You agree to use the Service lawfully and respectfully. You will not:
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Copy, scrape, resell, redistribute, or publicly post our content except as expressly allowed
- Share paid content or your account access with others
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Reverse engineer, disrupt, or interfere with the Service or its security
- Upload anything harmful, such as malware, or anything that violates the rights of others
We may suspend or end your access if you violate these Terms.
4. Paid memberships
Paid memberships, including the Founders Club, Rescue Plan and Full Kitchen are also governed by the specific membership terms presented to you at the time of purchase, which cover pricing, billing, automatic renewal, and refunds. Where those membership terms and these Terms both apply, the membership terms control for anything specific to your purchase.
5. Our content and intellectual property
The Service and its content, including the Rescue My Produce™ app, recipes, recipe books, guides, lessons, text, images, logos, and the PreserveWell™ and Rescue My Produce™ names and branding, are owned by PreserveWell or its licensors and are protected by intellectual property laws.
We give you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your own personal, non-commercial use. This license does not transfer any ownership to you, and all rights we do not expressly grant are reserved.
6. Feedback and submissions
If you send us ideas, feedback, reviews, or other suggestions, you give us the right to use them freely to operate and improve the Service, without any obligation or payment to you. Do not send us anything you consider confidential.
7. Food safety and health disclaimer
Please read this section carefully.
PreserveWell provides general information and guidance about food storage and preservation. It is educational and informational only. It is not medical, health, or professional food-safety advice, and it is not a substitute for your own judgment and safe food-handling practices.
Food preservation carries inherent risks, including spoilage and foodborne illness, if food is handled, stored, or prepared improperly. You are responsible for inspecting your own food, following safe practices, and deciding whether any food is safe to keep or eat. When in doubt, throw it out.
To the fullest extent permitted by law, PreserveWell is not responsible or liable for any illness, injury, loss, or damage resulting from your use of, or reliance on, any PreserveWell content or guidance.
8. Third-party links and services
The Service may link to or rely on third-party websites and services, such as our payment provider. We are not responsible for the content, policies, or practices of third parties. Your use of a third-party service is governed by that party's own terms.
9. Disclaimer of warranties
The Service and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any content is complete or accurate.
10. Limitation of liability
To the fullest extent permitted by law, PreserveWell and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred dollars.
11. Indemnification
You agree to indemnify and hold harmless PreserveWell and its owners, employees, and contractors from any claims, damages, or expenses arising from your misuse of the Service or your violation of these Terms.
12. Changes to the Service and these Terms
We may update, change, or discontinue parts of the Service at any time. We may also update these Terms. If we make a material change, we will take reasonable steps to notify you, and the effective date above will change. Your continued use of the Service after a change takes effect means you accept the updated Terms.
13. Transfer of the business
We may one day sell, merge, or transfer our business or its assets to another company. If that happens, these Terms and your account may be transferred as part of that transaction. We will take reasonable steps to notify users of any such change.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your information.
15. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service will be handled in the state or federal courts located in Tennessee, and you agree to that jurisdiction.

PreserveWell™ and Rescue My Produce™ are products of McRae Expert Services, LLC, which is not affiliated with, sponsored by, or endorsed by the USDA, the University of Georgia, or any Cooperative Extension service.
